1. Regulatory Framework – SRA vs FCA
Krowd Advisory Ltd operates in full compliance with Solicitors Regulation Authority (SRA) rules and does not engage in activities requiring Financial Conduct Authority (FCA) regulation under the Financial Services and Markets Act 2000 (FSMA).
Housing disrepair claims are legal matters falling under the Landlord and Tenant Act 1985 and the Homes (Fitness for Human Habitation) Act 2018. As such, legal representation for these claims is regulated by the SRA, not the FCA, provided claims management activities are not undertaken.
2. Why Krowd Advisory Does Not Require FCA Regulation
Krowd Advisory does not operate as a Claims Management Company (CMC) under FCA rules because:
✅ We do not provide legal advice – We facilitate referrals and evidence preparation, but all legal advice is given by SRA-authorised solicitors.
✅ We do not negotiate settlements – Krowd Advisory does not act as a legal representative, make claims on behalf of clients, or negotiate with landlords.
✅ We do not charge tenants for claims handling – No direct fees are taken from clients for claims management services.
✅ We only refer cases to SRA-authorised firms – We work exclusively with regulated law firms, ensuring all legal work is conducted by qualified solicitors.
3. Nature of Our Services
Our role is limited to:
Gathering supporting evidence (tenant statements, repair history, property condition reports, and photographic evidence) to support a potential Section 11 claim.
Screening cases based on predefined eligibility criteria before referral to a solicitor.
Referring packaged cases directly to an SRA-authorised firm for assessment and handling.
4. SRA Compliance & Case Referral Model
Krowd Advisory’s case preparation and referral service falls within the SRA’s referral and regulatory framework, meaning:
We do not engage in reserved legal activities.
We ensure client consent and transparency in all referrals.
We operate under SRA referral rules, ensuring solicitors retain full responsibility for legal work.
5. Conclusion: No FCA Authorisation Required
Krowd Advisory is not an FCA-regulated entity because we do not meet the FCA’s definition of a Claims Management Company. Instead, we operate as a case preparation and referral service in full compliance with SRA regulations.
